Terms and Conditions

Last updated 4th December 2020

These terms and conditions (“Terms”) apply to the iFollow premium digital content service (“iFollow”) accessed through your chosen Club official website (“Site”) and/or the official iFollow mobile app (“App”). These Terms apply to all use and access of iFollow, whether paid or provided on a free or promotional basis.

Please read these Terms carefully before submitting your order.

Access to iFollow is provided to you, the subscriber (“you”“your”) on the basis that you pay the Fee (as per the methods detailed below) and accept the terms of this contract.

Please note that your access to iFollow will also be subject to the Terms of Use (for access through the Site), end user licence agreement (“EULA”) (for access through the App) and applicable Privacy Policy, all of which (as updated over time) are incorporated into these Terms and form the contract. To the extent that these Terms conflict with the general Terms of Use or EULA, the order of priority shall be: (i) these Terms; then (ii) Terms of Use or EULA.

The contract is a legal agreement and it sets out the rights and obligations of you and EFL Digital Limited (“EFL Digital”“we”“us”“our”). We have been appointed by the Club under whose name this service is branded (“Club”) to operate the Site, Club section of the App and iFollow. Find out contact and other further details about both us and the club.

1. Registration and Username / Password

1.1. Once you have submitted your order to us, we will email you to confirm acceptance, at which point the contract between you and us will be formed. We may retain a copy of the contract details for our own records. If we cannot accept your order we will inform you by email. This may be because, for example (i) there has been a pricing error (see section 3) (ii) you failed to provide required information (see section 1.3) (iii) you have tried to order a subscription package which is not available in your territory or for which you are otherwise not eligible (iv) there has been an error in your initial payment of the subscription fee or (v) we have been affected by a recent unforeseen event which means iFollow cannot be made available in whole or part.

1.2 By submitting your order to us you confirm that:

1.2.1. you are at least 18 years old;

1.2.2. you are solely resident in the correct territory for your chosen subscription package. Please note content included in some subscription packages is only available in certain territories due to rights restrictions. Change to the territory in which you are located may affect availability of certain content, particularly live video content. Find out more about subscription packages and territory restrictions; and

1.2.3. the information which you provide is true, accurate and complete in all respects at that time. You must also notify us immediately of any changes to your information during your subscription by either updating the details in the My Account page of the Site or emailing iFollow@efl.com. As above, changes to your located territory may affect content access.

1.3. If we find that you have provided incorrect or inadequate information, your order may not be accepted and/or we may ask you to provide the correct and complete information. If you still fail to do so within a reasonable time, we may reject your order or end the contract (in the case of your error being uncovered after we have already accepted your order – see section 8). We will not be responsible for delay or failure in providing you access to all or part of iFollow if this is caused by you failing to provide us with the information needed and/or updating us of material changes to your information.

1.4. If you wish to upgrade your subscription package after your order has been accepted, you can do so through your “My Account” section of iFollow. We will let you know if the upgrade is possible and if so the applicable changes, including any increase in price and when the upgrade may take effect. You may be asked to confirm this change through the Site or email.

1.5. On registration you will be required to enter a user name and password. You must keep the password secure and not disclose it to any other person. Your right to use iFollow is personal to you and is limited to viewing on one device at any time. If your password becomes known by a third party, you must immediately change your password by logging into the My Account section of iFollow. We are not liable for any loss or damage arising from your failure to comply with this obligation.

1.6 For the purpose of your subscription we will only use your personal information as set out in our Privacy Policy.

2. Use of the Service

2.1. We provide you with access to various types of digital content within iFollow, as set out for the subscription package you selected on your order. This may include, for example, audio/video coverage of matches, statistics, photo galleries and/or video streaming of interviews and highlights. Your access is not exclusive (others can access the content too), may be suspended and/or terminated in accordance with these Terms, and may depend on the territory in which you are located or other applicable eligibility criteria set out in the order process.

2.2. iFollow content includes certain video and audio footage, photographs, text images, statistics, logos and other media and intellectual property related to the Club, the English Football League, Football Association, Premier League, us and the respective content licensees of those parties. All such content, design, text, graphics, footage, materials and their selection or arrangement are the intellectual property rights (including, amongst other things) copyright of us, the above parties and/or the respective licensees. You will not own any of the content.

2.3. For match footage shown on a live basis (certain geographical territories only) not all your chosen Club’s matches will be available for viewing on a ‘live’ basis. This is due to, amongst other things, restrictions with television broadcasters. View the television broadcast schedule.

2.4. iFollow is a content access service only. We are not providing, and are not responsible for any problems caused by your computer hardware, computer operating systems, internet connection or other software installed on your computer (and/or any traders you engage with in respect of such resources).

2.5. iFollow has not been developed to meet your individual needs. Please check that facilities and functions of iFollow (as described on the Site and/or App or relevant appstore) meet your requirements.

2.6. In order to access and use iFollow, you will need to:

2.6.1. provide all necessary equipment including a computer and network / telephone connection;

2.6.2. access the internet, and you are responsible for any service fees associated with such access. You will require a WIFI or broadband internet connection (DSL/cable or higher) of 800 kbps or higher to use the App. You can also access the App over a 3G/4G/5G connection via supported mobile devices. If you have an internet connection speed of 5 Mbps or higher and your computer meets the requirements below at section 2.7, you will be able to enjoy the App at its highest video quality.

2.7. For use of iFollow your device needs to comply with the following minimum system requirements (as may be updated occasionally, for which see section 3 below):

2.7.1. Site (Windows): 2.33GHz or faster x86-compatible processor, or Intel® Atom™ 1.6GHz or faster processor for netbooks; 32- and 64-bit (unless noted): Windows 8.1, Windows 10 and later new Windows releases; latest versions of Microsoft Internet Explorer, Microsoft Edge, Mozilla Firefox and Google Chrome; 1GB (32-bit) or 2GB (64-bit) of RAM; 128MB of graphics memory.

2.8. You must not (nor authorise or permit any other person to):

2.8.1. use iFollow contrary to this contract, including use for any unlawful purpose contrary to any applicable laws and regulations, including in the country from which you have accessed iFollow;

2.8.2. use iFollow other than for private and domestic purposes. Under no circumstances must iFollow nor any content be accessed or used for commercial or business purposes, without our prior written consent;

2.8.3. transmit any computer viruses or any other disruptive or harmful contaminants through iFollow, Site or App or the technology on which they rely;

2.8.4. use iFollow in a way that may cause it and/or any equipment used by us (or our technology partners appointed to help provide iFollow) to be interrupted, damaged, rendered less efficient or impaired, nor try to gain unauthorised access to any of systems through which iFollow is delivered;

2.8.5. store your password anywhere on a computer in plain text;

2.8.6. use iFollow in any manner which violates or infringes the rights of any person, firm or company (including, amongst other things, rights of intellectual property, confidentiality or privacy);

2.8.7. forward, record, copy, reproduce, store, transfer, modify, post, distribute or publish any of the content of iFollow without our prior written permission (unless otherwise specifically permitted by law);

2.8.8. sell, assign, transfer or delegate all or any of your rights and obligations in this contract to another person or organisation, or share use of or access to your iFollow account or any content contained or accessed within it;

2.8.9. alter, disassemble, decompile or reverse engineer any part of iFollow; or

2.8.10. access, view or use iFollow in circumstances where members of the public can view the content accessible via your account (whether simultaneously or not) or authorise any other person to do so; or

2.8.11. provide or utilise any technology (including, amongst other things, location blocking facilitites (such as VPN’s) or other methods to conceal your IP address) intended to facilitate you or any other person accessing iFollow or its content in circumstances where you and/or they are not otherwise eligible to do so in accordance with these Terms.

Any failure to comply with any of the above will be considered a serious breach of these Terms.

2.9 Content provided through iFollow is intended for use on a stand-alone basis only in accordance with the relevant subscription package selected. Content is not to be combined with other content sources – for example only, some match footage is only made available without commentary and must not be combined or overlaid with unauthorised audio commentary. This contract provides for access to your one chosen Club’s iFollow service only, and not any other similar service we may provide to other third parties or clubs.

3. Changes & Updates

3.1. We may change iFollow and/or these Terms without giving you notice in order to:

3.1.1. reflect changes in relevant laws or regulatory requirements;

3.1.2. implement minor or emergency technical adjustments, for example to address a security threat;

3.1.3. alter or improve the presentation of the user interface, or increase functionality (where this does not increase the price payable by you for your current subscription period);

3.1.4. implement and reflect planned changes we have prominently and specifically drawn to your attention when or before you submitted your order, or (in relation to any renewal) as part of your renewal reminder, referred to at section 5; or

3.1.5. implement other minor changes which would not reasonably be likely to cause you a material detriment in your use of iFollow nor increase the price payable by you in your current subscription, or which we reasonably believe to be for the benefit of users.

3.2. For more significant planned changes to iFollow and/or these Terms, you will be provided with reasonable notice of the planned change. For example, this may include:

3.2.1. removal of outdated or redundant features from iFollow; or

3.2.2. detrimental changes to the nature of or locations in which certain types of content relevant to your iFollow subscription are available. This is sometimes required to reflect changes in football (soccer) league/teams appointed broadcasters from time to time; or

3.2.3. if your Club is no-longer an EFL club (i.e. on promotion to the Premier League or relegation to the National League) and your subscription package included live streams of match footage we will no-longer be able to provide these due to broadcasting restrictions. However in those circumstances we will place you onto the next lower priced subscription package which your Club is then entitled to offer (if part of your subscription period is unexpired and you have paid your subscription in advance, a pro rata amount of the price difference will be refunded to you for that unexpired period – pro rata refunds won’t be applicable on automatic renewal).

After receiving such notice, you may then contact us before the change is implemented to end your subscription if you do not wish to be bound by the change, in which case your subscription will end at the end of that calendar month or expiry of your current subscription period (whichever is sooner) and you will receive a refund for any outstanding period of your subscription for which you have already paid. If you do not contact us to unsubscribe before the change is implemented, you will be deemed to have agreed to the change.

3.3. We may update the underlying software relating to iFollow, or require you to implement updates from time to time to continue accessing iFollow. For example, as time goes on you may need to ensure your system remains compatible with technical requirements (see section 2) or implement updates to the App.

3.4. If any change to these Terms or changes carried out in accordance with them is found invalid, void or for any reason unenforceable, only that change will be disregarded and it will not affect the validity and enforceability of any remaining changes or Terms.

4. Payment

4.1. You must pay the subscription fee applicable to the time period you have subscribed for (“Subscription Period”), in accordance with the fee plan notified to you at the time of registration and confirmed in our acceptance email sent to you (the “Fee”).

4.2. Except in the case of obvious error the Fee is as set out on the Site at the time of your application for an iFollow subscription. If we accept and process your order where a price error is obvious and unmistakeable and could reasonably have been recognised as such by you, we may end the contract and refund you any sums paid.

4.3. Unless otherwise stated, all Fees are inclusive of VAT or other similar sales tax in your territory. If the rate of VAT or similar sales tax in your territory changes between your order date and the end of the Subscription Period, we will adjust the rate on subsequent instalments of the Fee outstanding on your payment plan.

4.4. You are responsible for any other additional local taxes or duties applicable to the territory in which you reside or otherwise access iFollow from.

4.5. All payments must be in UK pounds sterling, unless we have expressly set out an alternative currency by which you may pay in the order process or any renewal notice. We cannot accept payment in currencies other than those expressly noted at the time you submit your order or in any subsequent renewal notice.

4.6. You may pay the Fee in a number of ways:

4.6.1. Credit/Debit card.The Fee will be automatically billed against the credit/debit card number that you provide in the registration form. Payment may be made by any of the following credit, debit or prepaid cards: Visa, Mastercard or America Express.

4.6.2. PayPal. You must provide your valid PayPal account details and the Fee will be billed against that PayPal account as set out in the fee plan notified to you.

4.6.3. Voucher. From time to time we or the Club may issue vouchers which will provide access to iFollow in accordance with the terms set out in the vouchers. Any additional terms and conditions applicable to the access provided by the voucher will be set out on the voucher. In the event of conflict with these Terms, the terms of the voucher will take priority.

4.7. We do not accept any responsibility for payments which are not received by us or accepted by your bank, other than where directly due to our fault.

4.8 We have contracted with NeuLion LLC (operating under its brand name Endeavor Streaming) to provide the streaming services that provide You (the subscriber who pays a fee) with the ability to access and view our content. The payment processing relating to the ability to view the content may also be provided by Endeavor Streaming on our behalf. Endeavor Streaming’s Terms of Use and Privacy Policy are available at  https://www.endeavorstreaming.com/.

Payment for the ability to view our content is made to Endeavor Streaming on our behalf, based upon the subscription plan that you sign up for. The subscription fee will be processed through Endeavor Streaming and will be processed in a secure manner by a third party payment services provider retained by Endeavor Streaming. Questions concerning payment processing can be directed to Endeavor Streaming, C Space House, 37 – 45 City Road, Old Street, London, EC1Y 1AT, United Kingdom, via live chat or email at iFollow@efl.com.

4. Automatic Renewal

5.1. This section 5 does not apply to any single match or other express pay per view arrangement.

5.2. Your subscription is for the Subscription Period and will, unless we notify you otherwise, be automatically renewed at the end of the previous Subscription Period for either an equivalent period to the Subscription Period, or other automatic renewal duration we have expressly noted to be applicable to your current selected subscription package.

5.3. Monthly Subscriptions: We will not normally send you reminders of renewal, unless there are changes in your renewal period you need to be aware of (see section 3 above). You can unsubscribe from iFollow with effect from the end of your monthly Subscription Period (or relevant renewal month) by contacting us at iFollow@efl.com not less than 5 days prior to the date of renewal. Your subscription will continue until the end of the month in which you notify us in accordance with this section and you will continue to be charged for that month.

5.4. Other Subscriptions: The following process will apply to your renewal:

5.4.1. a reminder will be sent to you by email at least 21 days before the end of your last Subscription Period reminding you that your subscription will automatically renew at the end of the current Subscription Period;

5.4.2. at the same time as that reminder, you will also be informed of:

5.4.2.1. the terms and conditions applicable to the renewed Subscription Period;

5.4.2.2. the price for that renewal period, if different from that for the current Subscription Period;

5.4.2.3. action you need to take if you do not want your subscription to be automatically renewed. Usually this will require you to email confirmation that you want to unsubscribe to iFollow@efl.com not less than 5 days prior to the date of renewal;

5.4.2.4. any other information we believe may be relevant to the renewed Subscription Period, including any significant changes such as those referred to in section 3.2.3 above; and

5.4.3. if your subscription is renewed as above (and you opted to receive your renewed subscription benefits immediately, waiving your right to cancel) you may only cancel the contract where we are not at fault if you provide us with at least 30 days’ notice of your desire to cancel. The contract will not end until the end of the calendar month in which that notice expires. You will be entitled to a pro-rata refund of any sums you have paid relating to the period after termination, less an administration charge of ten per cent (10%) of that refund value.

5.5. Unless you have opted to unsubscribe from iFollow not less than 5 days prior to the date of renewal your subscription will be automatically renewed. You will be deemed to have accepted the renewal on the terms and basis set out in the reminder (or, for monthly subscriptions where we have not notified you in advance of changes, on the same terms as your previous subscription). You will be charged in accordance with the same timings as under the payment plan applicable to your immediately preceding Subscription Period, unless otherwise notified to you as part of any reminder above.

5. Cancellation and Refunds – Please read carefully

6.1. By submitting your order you have opted to receive your subscription benefits immediately and waived your right to cancel. You will not therefore be entitled to cancel the contract any fourteen (14) day ‘cooling off’ period in law, nor receive a refund of the Fee. This does not affect any other rights you may have at law, including where we are at fault.

6.2. See section 5.4.3 above regarding cancellation after any automatic renewal.

7. Disclaimers and Liability

7.1. Neither we, the Club nor any of our staff or other representatives will be responsible or liable to you for any loss, damage, or inability to access and/or use iFollow which:

7.1.1. is due to any use you make of iFollow, other than that we permit under this contract;

7.1.2. is due to events outside our reasonable control. For example (and amongst other things) this may include fire, floods, severe weather, epidemics, terrorist activity or civil disruption;

7.1.3. is due to incompatibility of your devices or systems with the compatibility and technical requirements we have informed you of (see section 2 above);

7.1.4. is caused by viruses, Trojans, worms or other harmful data not caused by or attributable to an error or problem with iFollow, Site or App;

7.1.5. is caused by your failure to follow any reasonable, clear and easy to follow instructions we have made known to you relating to your use of iFollow. For example, if you fail to implement an important required update to the App; or

7.1.6. concerns loss or damage:

7.1.6.1. which is not a foreseeable result of our breach of these Terms (though we will be responsible for loss or damage which is foreseeable). Loss of damage is foreseeable if either it is obvious that it will happen or if, at the time we enter this contract, both you and we knew it might happen; or

7.1.6.2. relating to any business, including (amongst other things) loss of profits, loss of business, loss opportunity and/or business interruption. iFollow is made available for private and domestic purposes only.

7.2. We do not limit or exclude our liability for death or personal injury resulting from our negligence; fraud; or for breach of your mandatory legal rights (for example, including our liability in UK consumer contract law if iFollow digital content is not of satisfactory quality, fit for purpose, in compliance with its description or we are found to not have rights to provide such content). You should seek your own legal advice in relation to any such rights at law.

8. Suspension and Termination

8.1. We may suspend or terminate your access to all or part of iFollow at any time if:

8.1.1. (in the case of suspension only) you do not make payment to us when it is due;

8.1.2. (in the case of termination) you do not make payment to us when it is due (or such payment has failed or been refused by your payment service provider), and still fail to do so within 10 days after having had a reminder by email that it is due;

8.1.3. we are unable to verify or authenticate any information you have provided to us, where we reasonably need to do so (or information you have provided is incomplete) and you do not, within a reasonable time of us asking for it, provide us with required information that is necessary for us to start or continue making all or part of iFollow available to you;

8.1.4. you commit a serious breach of this contract, or commit a less serious breach which can be fixed and you have failed to fix it within 20 days of us notifying and requiring you to do so; or

8.1.5. your use of iFollow is reasonably considered abusive, excessive, or against the interests of other subscribers or persons,

and in each case no refund will be provided.

8.2. In addition we may close iFollow on service of not less than 30 days’ notice. If this occurs part way through your subscription, you will receive a pro-rata refund of any Fees you have already paid relating to the period of your current Subscription Period remaining as at the date of termination.

9.Maintenance

From time to time, iFollow may be taken down and your access to all or part of it suspended in order for work to be carried out relating to the upgrading or maintenance as necessary for the provision of iFollow. We shall give as much notice as is reasonable in the circumstances and shall endeavour to ensure that such works are carried out as expeditiously as possible in the circumstances, at times which minimise inconvenience to you. This may not be possible in cases of emergency to rectify significant faults, prevent further risk to you, other users or iFollow technology.

10. General

10.1. Any notices we send will be sent to the email address you supply during the registration process. We ask that any notices you send to us are sent by email to iFollow@efl.com. Notices will be deemed to have been delivered at the time and date of sending of the email, which time and date are specified in the email.

10.2. If we fail or delay to exercise or enforce any right we have under these Terms such failure or delay will not be deemed to be a waiver of that right nor will it prevent us exercising or enforcing that right on a later occasion.

10.3. This contract is between you and us. No-one else will have any rights to enforce its terms.

10.4. We may transfer our rights and obligations under this agreement to another organisation. We will always let you know if this happens and will ensure that the transfer does not affect your rights under this contract. Please note you need our consent to transfer your rights and obligations under this contract to anyone else.

10.5. This contract shall be governed by, and interpreted exclusively in accordance with, English law. Any dispute arising under this contract shall be subject to the exclusive (non-exclusive in respect of consumers resident outside England) jurisdiction of the English courts.

10.6. In addition please note that disputes may also be submitted for online resolution to the European Commission Online Dispute Resolution platform

11. Complaints

11.1. If you have any questions or complaints about iFollow, please contact us at iFollow@efl.com.

11.2. We will endeavour to respond to any complaint within 7 working days of receipt of such communication. If it is not possible to provide a full response to the issue raised within that time, an acknowledgement will be sent and a detailed reply will follow within 21 working days of receipt of the original communication.

11.3. We will attempt to resolve all justifiable complaints within 28 working days. If, however, this cannot be done, we will keep you updated on the progress of the complaint.

2. The Contract

2.1 The Agreement is made between AFCW and you on the Conditions set out here in.

If there is any inconsistency between any of the provisions of these Conditions and the provisions of any other of AFCW’s rules, terms and conditions or regulations, the provisions of these Conditions shall prevail.

3. Prices and Payment Terms

3.1 Payment of the price of your Season Ticket must be made as an upfront payment or the use of any Credit Facility.

3.2 The purchase of your Season Ticket shall not be complete until such time as the full amount of the price is received from you or the date of acceptance of any Credit Facility that you might have entered into, whichever is the earliest. For the 2024 2025 season, if you are paying by direct debit, payments will be taken over the 9 month period from 1st August 2024 until 1st April 2025, and in event of non-payment or repeated non-payment, we reserve the right to cancel your season ticket.

You shall be able to recommence making use of your Season Ticket once any arrears of payment to AFCW or regulated finance partner have been cleared.

3.4 AFCW shall have no liability to you for any failure by you to make use of your Season Ticket at a Match or any Matches due to the late payment of any sum by you in accordance with clause 3.3.

3.5 The age-related Season Ticket concession prices are based upon the supporter’s age on 1st August in the same calendar year the Season commences. Season Tickets cannot be purchased in respect of children under the age of three.

3.7 AFCW will charge you up to £10 to replace any lost, damaged or stolen Season Ticket. Should you lose or damage your Season Ticket, or should it be stolen, you should contact AFCW’s Ticket Office immediately.

3.8 Should an error relating to the price charged to you occur at the time your Season Ticket is purchased, for example (but not limited to), a miscalculation of the price of the Season Ticket based on your age as detailed at clause 3.5 above, AFCW reserves the right to request payment of the balance owing based upon the difference between the initial price attributed to the Season Ticket, and the actual price due once the error has been realised.

4. Cancellations by you

4.1 Subject to clause 4.3, you will have 14 days to cancel the purchase of your Season Ticket from the date of purchase. You must inform AFCW of your decision to cancel within this 14 day period in writing to AFCW’s registered office. If you cancel the purchase of your Season Ticket within this period, you will be refunded any amount of the purchase price that you have paid.

4.2 After the expiry of the 14 day cancellation period at clause 4.1, you will be able to cancel your Season Ticket but no refunds will be offered in respect of the price of your Season Ticket unless agreed by AFCW (such agreement to be in AFCW’s sole discretion and in exceptional circumstances only).

AFCW shall not be liable for any loss, damage or expense (including any indirect or consequential loss or damage, loss of enjoyment or travel costs), arising out of or in connection with a Match being cancelled, postponed, curtailed, abandoned or subject to a change of schedule for any reason whatsoever, including due to rescheduling of fixtures, the Rules, weather, government action, strike, civil commotion, national disaster, for health and safety reasons or otherwise due to circumstances beyond the reasonable control of AFCW.

5.2 In the event that any Match is cancelled, postponed or rescheduled, unless you have resold your Season Ticket for that match under our season ticket resale scheme, your Season Ticket shall be valid in respect of the rescheduled equivalent fixture; AFCW shall have no further liability in this respect.

5.3 In the event that a game is abandoned before half-time, unless you have resold your Season Ticket for that match under our season ticket resale scheme, you will be entitled to entry to the rearranged game at no expense. If a game is abandoned after half-time there will be no recompense.

5.4 No refunds will be made in respect of Matches not attended, postponed, delayed or rescheduled to accommodate live television coverage or for any other reason, or in any circumstance where AFCW has cancelled your Season Ticket as a result your conduct or otherwise for a breach of the Agreement.

6. Liability

6.1 Subject to clause 6.6, AFCW shall not be liable for: (i) any loss suffered by you or your Guest(s) as a result of the exercise by AFCW of any of its rights under these Conditions; (ii) any loss, damage or injury to you or your Guests including any property belonging to you or your Guests in or around the Ground (including its approaches and car park) however caused; (iii) any indirect, incidental, special or consequential liability; (iv) any loss of profits, loss of use, loss of opportunity or loss of or damage to goodwill; (v) any losses arising from any interruptions and/or restrictions to the view of or enjoyment of a Match unless caused by the actions of AFCW; or (vi) any loss incurred arising out of or in connection with any cancelled, postponed or abandoned Match or any rearranged fixture.

6.2 Subject to clause 6.6, AFCW’s total aggregate liability to you and/or your Guests arising out of or in connection with the Agreement shall not exceed a sum equivalent to the price of your Season Ticket.

6.3 No liability is accepted by AFCW for any acts or omissions on the part of any of its suppliers, subcontractors or agents, except to the extent where (i) AFCW has direct control over such supplier, subcontractor or agent and (ii) such supplier, subcontractor or agent are acting in accordance with any instructions given to them by AFCW, and whose own conditions of trading shall be deemed to be accepted by you.

6.4 You shall indemnify AFCW from and against all claims, costs demands, fines and expenses including legal fees which arise as a result of any actions or omissions of you or any of your Guests in breach of the Agreement including, without limitation, in respect of any damage to the Ground caused by you or your Guests.

6.5 AFCW has no responsibility for any property or personal effects of you or your Guests in or around the Ground (including its approaches and car park).

6.6 Nothing in these Conditions shall limit or exclude AFCW’S liability for (i) death or personal injury caused by its negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability which cannot be limited or excluded under applicable law.

7. Ticket Conditions

7.1 Season Tickets are issued subject to the Terms and Conditions of entry and the Ground Regulations, both of which you agree to abide by as well as all other rules and conditions imposed by AFCW from time to time, relating to any Match and the Ground including, without limitation, any and all conditions of sale applicable to Season Tickets, and any other rules relating to attendance of the Match.

7.2 – Season ticket holders under the age of 14 must be accompanied by someone over the age of 18 when visiting a match. Anyone under the age of 14 trying to enter the stadium alone may be refused entry and no refund will be made available. If an unaccompanied child under the age of 14 is denied access, we will notify the police on duty at the stadium who will assist in returning the child to their parents. We advise all children under 18 who are attending the game without an adult to have some form of proof of age.

7.3 Your Season Ticket permits you access to the Ground during its public opening hours on a game day and gives you the right to sit in the seat detailed on the Season Ticket during each such Match, subject to these terms and Conditions.

7.4 Your Season Ticket does not grant you access to cup fixtures played at the Ground. Season Ticket holders are granted an exclusive period to purchase their Season Ticket seat in respect of cup fixtures played at the Ground. This period of exclusivity will be determined by AFCW and the duration may vary. If you have not purchased a ticket in respect of your seat for such cup fixture before the expiry of the exclusive period, AFCW may sell a ticket for your seat for such cup tie by way of general sale.

7.5 AFCW reserves the right to relocate your Season Ticket to any other seat in the Ground, so long as that seat is not located in a lower price category area, particularly in accordance with rules determined by participation in cup competitions where the visiting club have the right to take a larger ticket allocation than those determined under normal EFL or Premier League rules. AFCW may take the decision to relocate your seat in its reasonable discretion; reasons for such relocation may include compliance with any EFL or Football Association requirement, television broadcasting reasons, the need to undertake construction or maintenance work at the Ground or the need to relocate you for reasons relating to your safety or the safety of others.

7.6 If you have already provided written proof of your identity and date of birth to AFCW’s Ticket Office in the form of a copy of either your current passport, photo card, driving licence or birth certificate, plus a recent passport style photograph, you will be able to renew your age-related concession Season Ticket. If you are purchasing a new age-related concession Season Ticket, or your activated account doesn’t currently hold written proof as to your identity and date of birth, your Ticket will not be issued until the appropriate proof has been presented to AFCW’s Ticket Office.

7.7 Your Season Ticket is issued for your use only and you shall not sell, assign or transfer your Season Ticket to any other person, other than permitted under these rules or under our resale policy. Should you be unable to attend any particular Match, you are permitted to allow a Guest to use your Season Ticket in respect of that Match.

7.8 In circumstances where your Guest would be liable to pay a higher Season Ticket price for the Match they attend in your place than you were they to purchase the Season Ticket themselves (owing to them falling in to a different age category to yourself) you/your Guest shall be required to visit AFCW’s Ticket Office to pay the relevant increase in the price, which will be the difference between the match ticket price of your Season Ticket age-band, and the price due for the upgraded age-band match ticket, prior to being able to use your Season Ticket. Any attempt by any such Guest to enter the Ground without paying the increase in price, shall be a breach of these Conditions and shall permit AFCW to take any of the action detailed in clause 8.3. In circumstances where your Guest would be liable to pay a lower Season Ticket price than you, were they to purchase the Season Ticket themselves (owing to them falling into a different age category to yourself) neither you nor your Guest shall be entitled to any rebate or refund from AFCW. You shall ensure that your Guest(s) shall not sell, assign or transfer your Season Ticket to any other person.

7.9 References in these Conditions to selling a Season Ticket includes offering to sell a Season Ticket (including, without limitation, via any online auction website), exposing a Season Ticket for sale, making a Season Ticket available for sale by another person and/or advertising that a Season Ticket is available for purchase. For the avoidance of doubt (and by way of example only) your Season Ticket may not be offered as a prize in any promotion or competition, transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy some other goods or services, or used for any other commercial purpose (all save as expressly authorised by the League, and/or AFCW).

7.10 The unauthorised sale or disposal of a Season Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. AFCW will inform the police in the event it becomes aware that a Season Ticket has been sold illegally and will press for charges to be brought against those breaking the law. If you are convicted of a ticket touting offence, or AFCW reasonably suspects you have committed such an offence, AFCW will notify the League who may in turn notify other clubs and/ or the relevant law enforcement authorities. The information that AFCW shares may include yours and your Guests’ personal data, information about the offence and about ticket purchases (including payment details). AFCW will use this to identify and prevent ticket touting offences and disorder at matches.

7.11 Season Tickets shall not be resold or transferred save as set out in these Conditions and shall not be purchased or obtained from or through any commercial agent or company or otherwise than directly from AFCW or an official agent. Any Season Tickets obtained in breach of these Conditions shall be void and all rights conferred or evidenced by such Season Tickets shall be nullified. Any person seeking to use a Season Ticket in breach of these Conditions in order to gain or provide entry to or remain at any Match may be refused admission to or be ejected from the Ground and may be subject to legal action.

7.12 The use of a Season Ticket by any Guest will be subject to these Conditions and the Ground Regulations which will apply to and bind that Guest as if they were the original purchaser of the Season Ticket. You must inform the Guest of this and AFCW may hold you responsible if you do not. References in these Conditions to ‘you’ will be construed as including any Guest, if applicable. You will remain liable for the conduct of your Guest whilst they are using your Season Ticket and any breach of the Rules or of these Conditions by your Guest will also be treated as a breach of the Rules or these Conditions by you.

7.13 As a condition of admission, you and your Guests will be subject to the Ground Regulations in force at the time of booking and as amended from time to time. Your attention is drawn in particular to the following Ground Regulations:
- Regulation 1: AFCW reserves absolutely the right to eject from the Ground any person failing to comply with any of the Ground Regulations or whose presence within the Ground is, or could, reasonably be constructed as constituting a source of danger, nuisance or annoyance to any other person.
- Regulation 9: The use of threatening behaviour, foul or abusive language is strictly forbidden and will result in arrest and/or ejection from the Ground.
- Regulation 17 : Under the Sporting Events (Control of Alcohol etc) Act 1985, the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made:
- Regulation 17.1 : Attempting to enter the Ground or being inside the Ground whilst drunk; and
- Regulation 17.2: Being in possession of any intoxicating liquor, bottle, can or any other portable container which could cause damage or personal injury when entering the Ground or in a public area of the Ground from which the event can be directly viewed.

7.14 No food or drink is permitted to be brought into the Ground by you or any of your Guests.

7.15 Save only as set out in the Ground Regulations, no person may bring into the Ground or use within the Ground any equipment which is capable of recording or transmitting (by digital or any other means) any audio, visual or audio-visual material or any information or data in relation to a Match or the Ground.

7.16 Smartphones and mobile telephones are permitted within the Ground provided they are used purely for the purpose of access to the Internet for information updates or the transmission and/or reception of voice data only. Live recording and streaming of the game or being used to provide commentary of the Match in progress is not permitted.

7.17 CCTV is employed and operated within the Ground for the purpose of control and safety of spectators and prevention of crime. Where necessary, recorded images may be used as evidence.

7.18 You acknowledge that photographers will be present at various Matches throughout the Season and some crowd photographs may be used for media purposes. You hereby acknowledge that your image may be used in this manner.

7.19 If you forget your season ticket for a particular match, we will provide a ticket reprint for the match on payment of a £2 fee. We will only do this once a season

8. Guests

8.1 Any breach of the Agreement by any of your Guests shall be deemed to be a breach of the Agreement by you.

8.2 You shall be responsible for your compliance and observance (and that of any Guest) with the Agreement. Any act or omission by a Guest shall be deemed to be your act or omission. Misconduct by you or your Guest(s) and/or failure to adhere to the Agreement or you or your Guest(s) acting in a manner which AFCW considers is detrimental to its interests or is likely in the reasonable opinion of AFCW, to bring football or AFCW into disrepute, shall permit AFCW to confiscate or forfeit (in each case without compensation) their Season Tickets and/or ban you and/or your Guest(s) from attending future Matches or other events at the Ground for such period of time as AFCW deems appropriate.

8.3 In the event that you or a Guest is in breach of the Agreement, AFCW reserves its right to take one or more of the following steps which it in its absolute discretion deems appropriate: (i) evict the person from the Ground; (ii) withdraw and cancel any Season Ticket; (iii) issue limited or lifetime bans; (iv) report the matter to the League who in turn may notify other clubs and/or the UK Football Policing Unit; (v) report the matter directly to the police; and/ or (vi) take legal action. In any of these circumstances, no refund of all or any part of the price paid for your Season Ticket will be paid by AFCW. You also acknowledge that you may face action from the police in the event of certain of these breaches which may, among other things, render you liable to a fixed penalty fine and/or criminal prosecution.

8.4 All season ticket holders that would like to bring an additional family member, friend or colleague to a match, but have no space next to their existing seat, will have the ability to swap their seat on a match by match basis to another group of unallocated seats within the stadium at the same or lesser level free of charge. Their friend will then be able to purchase the adjoining seat(s). By doing this, you agree to give up your seat for resale by the club for that particular match. This is subject to availability and also at the discretion of the club.

8.5 If you permit a Guest to use your season ticket for a game under the terms of this Agreement, but your Guest is unable bring your season ticket to the game in question, you must email our ticketing office the day before the game to inform us of the Guest who is permitted to use your season ticket, together with your season ticket number. If you do not do so your Guest will not be permitted to the Stadium.

9. Etiquette & Conduct

9.1 Under no circumstances may you permit your Season Ticket to be used by any person, including you or any of your Guests, that may favour the Visiting Club, as your Season Ticket will be located within the home supporters’ area in the Ground.

9.2 You shall be responsible for ensuring the good and orderly behaviour of all of your Guests whilst at the Ground and during the Match. If your Guest behaves in a loud, disorderly, unruly or abusive manner or draws attention to themselves in their viewing seats, then your Guest may be required to leave the Ground.

9.3 AFCW reserves the right to exclude or eject any person from the Ground if, in its reasonable opinion, their behaviour is likely to cause distress, damage or annoyance to other persons or property. AFCW shall not compensate any person in any way in respect of such removal or requirement to leave the Ground.

9.4 AFCW reserves the right to charge you the cost of rectifying damage caused by the deliberate, negligent or reckless act of you and/or your Guest to the Ground or AFCW’s property.

9.5 Your right to access the Ground on the day of the Matches will be solely for the time period that AFCW opens the Ground to the public on each such day

10. Use of Marks

10.1 You may not use any intellectual property, trademarks, names (including nicknames) or logos of AFCW or any of its associated group companies, or images of the Ground or AFCW’s players, or claim any association with AFCW without AFCW’s prior written consent.

10.2 Save for official AFCW merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

11. Duration of Agreement and Renewal

11.1 If you purchase your Season Ticket and you pay for this without the use of a Credit Facility, this Agreement will expire on the day following the final Match of the Season.

11.2 If you purchase your Season Ticket and you pay for this by way of the use of a Credit Facility, your Season Ticket shall automatically renew (in accordance with the terms and conditions mentioned in clause 11.3) at the end of the Season (and at the end of each subsequent Next Season) in respect of the forthcoming Next Season unless you shall have cancelled your Season Ticket in accordance with clause 11.3.

11.3 AFCW or its regulated finance partner may write to you in future regarding the renewal of your Credit Facility, including the terms and conditions relating to that Credit Facility and the repayment terms, as regards the funding of your Season Ticket in respect to the Next Season. You shall be provided with a thirty-day period to cancel your Credit Facility if you do not want this to renew automatically. If you confirm directly to AFCW or our regulated finance partner that you wish to cancel your Credit Facility before the deadline for so doing, your Season Ticket will be cancelled in respect of the Next Season and you will not be charged.

11.4 If you do not confirm to AFCW or our regulated finance partner that you wish to cancel your Credit Facility before the deadline for so doing, your Season Ticket may be automatically renewed in respect to Next Season and you will become liable to repay AFCW or our regulated finance partner in accordance with the terms of your Credit Facility.

11.5 All terms of this Agreement that by their nature are intended to survive termination or expiry of this Agreement, will survive the termination or expiry of this Agreement.

12. Debentures

12.1 If you hold a valid debenture then you will have the automatic right to renew and buy a Season Ticket in your chosen seat, subject always to the terms on which you purchased your debenture. Your seat cannot be sold by the club as a season ticket until the expiry of the debenture term or by forfeiting through any breach of the regulations here outlined in this document.

12.2 If you do not hold a valid debenture, your chosen seat is not guaranteed nor secured. If you fail to renew your season ticket within the time frame designated by the club, you will forfeit your rights to that seat and the club will be able to sell your seat again.

14. General

14.1 Should any part of the Agreement for any reason prove ineffective or unenforceable that provision or part provision shall, to the extent required, be deemed to be deleted, and the validity of the remaining terms and conditions shall not be affected and shall be enforceable. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

14.2 No delay or omission on the part of either party in exercising any right, power or remedy provided by law shall impair such right, power or remedy, or operate as a waiver thereof.

14.3 No alterations to the Agreement made between you and AFCW for the sale and use of any Season Ticket may be made except with the express written consent of both parties.

14.8 The Agreement and any disputes under it shall be governed and construed in accordance with the laws of England and Wales and each party shall irrevocably submit to the exclusive jurisdiction of the English and Welsh courts.

Any reference to reselling the Home Match Ticket in these Conditions includes reference to offering to sell a Home Match Ticket, exposing a Home Match Ticket for sale, making a Home Match Ticket available for sale by another and advertising that a Home Match Ticket is available for purchase. Such transfer must not be to a supporter of the away club at any Home Match and will in any event be subject to these Conditions (and any other applicable Club terms, conditions or regulations) which will (save for any rights to transfer under this clause or any rights to a refund under clause 5.4) apply to the transferee as if he were the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club or any police officer.

4.4 If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her personal use only provided that such transfer takes place to a person who is a Club supporter, such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. In the event of any cancellation and withdrawal in accordance with this clause 4.6, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorised use of the Home Match Ticket.

5. Changes to Dates, Refunds & Exchanges

The Club reserves the right to abandon, postpone and/or reschedule any Home Match without notice and save as set out in clause 5.3, such abandonment, postponement and/or rescheduling shall be without any liability to you (including without limitation in relation to any loss, damage, costs or expenses suffered or incurred by you).

5.2 In the event that a game is abandoned before half-time, paying spectators will be entitled to either entry to the rearranged game at no expense or a full refund, subject to clause 5.4. If a game is abandoned after half-time there will be no recompense.

5.3 In the event of the postponement or cancellation of any Home Match, you will, subject to clause 5.4, be entitled to receive either a full refund or the equivalent ticket for the subsequent rescheduled Match via such application procedure as the Club stipulates. The Club will have no further liability to you whatsoever, including (but not limited to) any indirect or consequential loss or damage, costs or expenses or loss of enjoyment or travel costs suffered or incurred by you.

5.3 In order to obtain a refund, the Home Match Ticket must be returned to the Club's ticket office within 7 days of the abandonment or cancellation announcement (which shall be made on the Club’s website where possible). Tickets which include hospitality are subject to their own terms and conditions. It is the responsibility of the ticket holder to check the date and kick off time of Home Matches. A refund will only be issued where it is established upon production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the Club shall have the final decision as to whether to issue a refund and such decision shall be final and binding. Under no circumstances will refunds be issued less than 48 hours before the match.

5.4 The Club reserves the right, at its absolute discretion, to increase or decrease the price of Home Match tickets and/or to alter the categorisation of Home Matches from time-to-time. The Club will publish details of any such price changes or categorisation changes on its official website as soon as possible after the implementation of such change. Any purchase of Home Match tickets after the change shall be subject to the new prices and/or new designated category.
